There was an on going discussion at Apple's site about the App store.
The users had problems with the not working App buttons, as well as some iOS 3 users had problems in downloading apps!
Well, this wasn't surely a problem which Apple caused to force its users to update their firmware, as the App store have been restored.
And according to Engadget, they have confirmed it for iOS 3.1.3:
We've confirmed that ourselves on a first-generation iPod touch running 3.1.3, as have a number of iPhone and iPod touch users on the official Apple support forums
