Motorola's lawsuit against Apple being dismissed in Germany!

On Friday, the Mannheim Regional Court of Germany announced that Motorola’s patent lawsuit against Apple had been dismissed.


Last month, there were reports that Motorola was going after Apple with a lawsuit claiming patent infringement. Since then, German courts have ruled twice in the favor of Motorola, but the company suffered a minor defeat today when the court shot down a third patent case.

The patent in question, EP1053613, is considered essential to the 3G/UMTS wireless standard and, more specifically, pertains to a "method and system for generating a complex pseudonoise sequence for processing a code division multiple access [CDMA] signal." Motorola Mobility had argued that Apple's products infringed upon this patent, but Judge Andreas Voss on friday dismissed these claims, on the basis that the plaintiff failed to demonstrate Cupertino's violation. 


Apple says that as a Qualcomm customer, Apple is a third-party beneficiary of Motorola's agreement with Qualcomm. Under that agreement, Motorola's rights under certain patents are exhausted, Apple argues.
